SDS is compiling a “clean-up” package of regulations to address unintended consequences related to the new waiver regulations released on 7/1. Examples of issues that have been identified include:
- Requirements for 1-on-1 supported living services: Need to examine the potential impact on the ability of providers who have developed more congregate settings (i.e. apartments where one provider supports multiple individuals living in an apartment building).
- Access to Nursing Oversight and Care Management for individuals receiving services via the APDD/ALI waivers: Private duty nursing is not always available, particularly in rural areas.
- Requirements related to medication assistance: nurse-approved training requirement difficult especially for smaller providers, rural providers – reducing availability of respite/PCA services.
- Late LOC/set POC date dilemma: need to add a caveat in the regs that directs the care coordinator to submit a plan of care without a level of care in the event the level of care is late.
